A summary of Spend Cap regulation in the Digital Economy Act 2017

What is a Spend Cap?

From 1st October 2018, Business customers will be able to choose to apply a Spend Cap on end users’ monthly tariff to control spend on out-of-bundle charges.

Any chargeable usage outside of end-user monthly allowance or outside of any Bolt-On allowance will count towards end-user Spend Cap.

We’ll email the bill payer and text the end-user when our systems detect that the end-user has used 50% of their Spend Cap, and again if they use 100%. If the Spend Cap is set at £0 or once it reaches 100%, any further chargeable out-of-bundle usage may not be possible. This means that if the end-user use their monthly allowance and any Bolt-On allowance, any additional chargeable usage may be barred.

Which tariffs can a customer take a Spend Cap on?

Spend caps are available to new and re-signing customers on all our O2 tariffs offered. They are not available on tariffs with other networks, shared minutes or shared data.

Can a customer choose any value of Spend Cap?

Customers can choose no Spend Cap or a Spend Cap valued at £0, £5, £10, £15, £20, £30, £60, £100 or £200.

What counts towards the end user’s Spend Cap?

Any chargeable usage outside of the monthly allowance or outside of any Bolt-On allowance such as:

  • Additional calls, texts and data usage
  • Calling and texting non-geographical or premium rate numbers aside from those premium rate numbers relating to charities which sit outside your Spend Cap, as set out below
  • Calling and texting any international number from the UK
  • Calling and texting any number outside of our Europe Zone when you’re in our Europe Zone (excluding the UK)
  • Calling, texting and using data when you’re in a country which is outside of our Europe Zone
  • Calling directory enquiry services
  • The charge you pay to O2 for accessing any third party services
  • Any charity donations made from your phone.

What doesn’t count towards the Spend Cap?

  • Recurring charges for the Airtime Plan, Device Plan, and insurance
  • The price for purchasing a Bolt-On which you opt-in to e.g. Rest Of World Pass
  • Any charges relating to the management of your account which includes, but is not limited to, paper bills, itemised paper bills and late payment fees
  • Any charges for third party services (our access fees for these services are however covered in your Spend Cap as set out above).

What happens if an end user reaches their Spend Cap?

Any further chargeable out-of-bundle usage may not be possible. If they use up their monthly allowance and any Bolt-On allowance they may have, additional calls, texts and data usage may be barred. End users will always be able to make calls to Annodata Mobile Team and calls to emergency services from your mobile.

What can the end user do if they reach their Spend Cap but want to make additional chargeable usage?

  • The bill payer (or the end user, if authorised by the bill payer) may increase their Spend Cap by calling the Annodata Mobile Team (on 01417 663320) or by emailing mobileorders@annodata.co.uk
  • The bill payer (or the end user, if authorised by the bill payer) may choose to remove your Spend Cap by calling the Annodata Mobile Team (on 01417 663320) or by emailing mobileorders@annodata.co.uk
  • The bill payer (or the end user, if authorised by the bill payer) may buy a one-off or recurring Bolt-On if the end user needs extra minutes, texts or data. The Annodata Mobile Team will support this process.
  • The bill payer (or the end user, if authorised by the bill payer) may opt-in to buy our Rest Of World Pass for roaming in destinations outside our Europe Zone.The Annodata Mobile Team will support this process. Click for more information.

What does it mean if a customer chooses a £0 Spend Cap?

If the end user use up their monthly allowance and any Bolt-On allowance, any additional chargeable usage may be barred. The bill payer and the end user will receive a notification at the beginning of each billing cycle letting them know that the Bill Spend cap is £0.

How often can customers change their Spend Cap?

  • Only the bill payer can amend, remove or add a Spend Cap unless the end user is authorised by the bill payer to do so
  • Once a day, the bill payer (or the end user, if authorised by the bill payer) can add, remove, increase, or reduce, their Spend Cap at any point by calling the Annodata Mobile Team (on 01417663320) or by emailing mobileorders@annodata.co.uk
  • For each monthly billing period, we’ll apply the Spend Cap which is active at the end of the month to the entirety of that billing period.

What can the bill payer (or the end user, if authorised by the bill payer) do if they receive a text saying they are barred because they have reached their Spend Cap limit?

  • Increase their Spend Cap by calling customer service (8002 for free from their O2 mobile), the Annodata Mobile Team (on 01417663320) or by emailing mobileorders@annodata.co.uk
  • Choose to remove their Spend Cap by calling customer service (8002 for free from their O2 mobile), the Annodata Mobile Team (on 01417663320) or by emailing mobileorders@annodata.co.uk
  • Buy a one-off or recurring Bolt-On if they need to extra minutes, texts or data
  • They can choose to opt-in and buy Rest Of World Pass Bolt-On which can be used for roaming in destinations outside O2’s Europe Zone.

The customer is travelling outside of O2’s Europe Zone, has a Spend Cap and hasn’t opted into Rest Of World Pass. Can they still make calls, send texts and use data?

Customers will be able to make and receive calls and texts and use data. Charges will all count towards their Spend Cap.

These out-of-bundle charges may mean that their Spend Cap will be used up more quickly than it would if you were at home or travelling in O2’s Europe Zone.

They can opt-in to buy Rest Of World Bolt-On if they are heading to a destination outside our Europe Zone

The customer is travelling outside of O2’s Europe Zone and doesn’t have a Spend Cap, are they protected?

Customers travelling outside of our Europe Zone and that haven’t selected a spend cap will automatically benefit from Rest Of World Pass, they will get up to 500MB, 200 mins, 200 text, 24 hours from when they use for £7.50. They will be capped at one Pass per 24 hours.  Customers can change their capping option to:

  • Two Passes per 24 hours
  • Uncapped Passes
